Welcome to Genesis (“Genesis”, “we”, “us”, or “our”). By using our services, you agree to these Terms of Service (“Terms”). If you don’t agree to all of the Terms, you may not use our services.

We provide our users with trading services and information, such as price forecasts, news, and analytics (collectively the “Services”). To use the Services, you must have access to the internet, a device that is consistent with our system requirements, and any necessary software.

We don’t provide any kind of guarantee or assurance as to the success of trades or investments you make while using the Services, and we exempt ourselves of any responsibility or liability related to any losses, damages or cost incurred through or as a result of the Services. All investments you make are at your own risk.

You must use the Services for lawful purposes only. You may not:

1. violate any applicable law, including using the Services for money laundering or terrorist financing activities;

2. interfere or try to interfere with the integrity or proper working of the Services;

3. facilitate any third party to do any of the above;

4. engage in any activities that are illegal or fraudulent.

Certain services require you to create an account. You are solely responsible for keeping your account password and other account information secure, and for all activities that occur under your account.

Certain services may require you to pay one-time fees or subscription fees (“Fees”). Payment of all Fees is due upon signup, and if you fail to timely pay the Fees, we may restrict your access to the services and/or terminate the Terms with immediate effect.

We (and our licensors) own all of the intellectual property rights in relation to the Services and the Genesis website and any associated content, software, designs, or other material (collectively the “Genesis Content”). You have no rights to the Genesis Content, other than the limited right to use it in accordance with these Terms.

We provide the Services on an “as is” basis and make no warranties, either express or implied. We hereby disclaim all warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of the Services.

You understand and agree that we will not be liable for any damages, direct or indirect, resulting from the use or misuse of the Services. This includes but is not limited to losses resulting from technical difficulties, negligence, breach of contract, fraud, or tortuous events.

In any event, our total liability for any claims arising out of or related to these Terms will not exceed the lesser of the amount paid for the Services or one hundred U.S. Dollars (USD $100).

You agree to indemnify and hold harmless Genesis and its officers, directors, employees, and agents from any and all claims, damages, losses, or liabilities (including, but not limited to, reasonable attorneys' fees and court costs) that arise out of or relate to your use of the Services.

You or we may terminate these Terms at any time. We may also terminate these Terms with immediate effect by disabling your access to the Services if you violate any provision of these Terms.

If a dispute arises out of or relates to these Terms or the Services, the parties shall try to settle it by negotiation. Should this fail, the dispute shall be referred to arbitration in accordance with the Rules of the American Arbitration Association.

1. These Terms shall be governed by the laws of the State of California without regard to conflicts of law principles.

2. All notices shall be sent to the registered address of either party.

3. These Terms constitute the entire agreement between the parties and supersede all prior agreements, negotiations, and representations.

4. Genesis may modify these Terms from time to time. If you don’t agree with the new Terms, you have the right to terminate these Terms.

6. If any part of these Terms is held to be unenforceable, the enforceable parts remain in full force and effect.

7. This agreement will be binding on you, your successors, and assigns.
